App Terms of Use

Agreement to terms

By creating an account and using the Be Right Back! application at berightbackapp.io (“the app”), you agree to be bound by these Terms of Use. The app is operated by Julie Naismith (“we,” “us,” “our”), a business based in British Columbia, Canada.

Description of service

The Be Right Back! app is a web-based separation anxiety training tool for dog owners. The app provides:

• Customized training plans based on your dog’s progress
• An exercise timer and session tracker
• Training history and progress visualization
• AI coaching through Smart Percy, our AI training assistant
• Community features including leaderboards and social connections
• Access to certified dog separation anxiety trainers (depending on your membership level)

Account registration

To use the app, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 16 years old to create an account. If you are under 18, you must have permission from a parent or guardian.

Subscription and payments

Access to the app requires a paid subscription through the Be Right Back program membership. By subscribing, you agree to the following:

• Subscriptions are billed monthly through Stripe
• Your subscription will automatically renew each billing period unless you cancel
• You may cancel your subscription at any time through your account settings or by contacting us
• Cancellation takes effect at the end of your current billing period — you retain access until then
• We do not offer refunds for partial billing periods

We reserve the right to change subscription pricing with 30 days’ notice. Price changes will not affect your current billing period.

AI coaching (Smart Percy)

Smart Percy is an AI coaching assistant built into the app. Smart Percy provides training guidance, answers questions about separation anxiety, and offers support based on your dog’s specific training history.

Smart Percy’s responses are based on established separation anxiety training protocols and data from thousands of dogs. However, Smart Percy is not a substitute for professional veterinary advice. If your dog shows signs of a medical condition, please consult a veterinarian.

Conversations with Smart Percy may be reviewed to improve the quality of the coaching service. See our Privacy Policy for details on how your data is handled.

Your training data

When you use the app, we collect and store your training session data, including durations, ratings, and notes. This data is used to:

• Generate your personalized training plans
• Provide coaching responses tailored to your situation
• Show your progress history and statistics
• Improve our training algorithms and coaching quality

We may use aggregated, anonymized training data for research and to improve our services. Individual data is never shared publicly without your explicit consent.

Acceptable use

You agree to use the app only for its intended purpose of dog separation anxiety training. You agree not to:

• Share your account credentials with others
• Attempt to reverse-engineer, copy, or modify the app
• Use the app to harass, abuse, or harm other users
• Post inappropriate, offensive, or misleading content in community features
• Use automated tools or bots to interact with the app

We reserve the right to suspend or terminate accounts that violate these terms.

Family accounts

Your membership allows you to add family members to your account. Family members share access to training data for your dogs. You are responsible for ensuring all family members comply with these terms.

Intellectual property

The app, including its design, code, training algorithms, content, and the Percy coaching system, is the property of Julie Naismith and is protected by intellectual property laws. Your subscription grants you a personal, non-transferable license to use the app. It does not transfer any ownership rights.

Disclaimer

The Be Right Back! app is a training tool, not a veterinary or behavioral service. Results vary between dogs. We do not guarantee specific training outcomes or timelines.

The app is provided “as is” and “as available.” We make no warranties, express or implied, regarding the app’s availability, accuracy, or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Julie Naismith shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. This includes damages related to your dog’s behavior, training outcomes, or any decisions made based on information provided by the app or Percy.

Service availability

We strive to keep the app available at all times but do not guarantee uninterrupted access. We may temporarily suspend the app for maintenance, updates, or circumstances beyond our control. We will endeavor to provide advance notice of planned downtime.

Governing law

These terms are governed by the laws of British Columbia, Canada. Any disputes arising from these terms shall be resolved in the courts of British Columbia.

Changes to these terms

We may update these terms from time to time. We will notify you of significant changes by email or through the app. Your continued use of the app after changes take effect constitutes acceptance of the updated terms.
